When employees leave your company of at least 20 employees, you are required by law to send COBRA administration forms to these former employees, who are eligible to receive COBRA benefits. Failure to do so results in a $100 fine each for your company and your human resources administrator. Additionally, failure to do so may result in a claim by the former employee of as much as 10 percent of the COBRA benefits claim or $500,000, whichever is smaller.
